O Tribunal de Justiça da Paraíba (TJ-PB) concedeu, na manhã desta segunda-feira (30), uma Antecipação de Tutela que determina a imediata suspensão da greve dos professores do município de João Pessoa. A decisão foi tomada pela desembargadora Maria das Graças Moraes Guedes, que entendeu que a paralisação da categoria afeta diretamente a vida dos alunos, podendo causar “danos irreparáveis ou de difícil reparação”.

Entre os prejuízos elencados pela desembargadora estão a “possibilidade de comprometimento do ano letivo” e de “potencialização do problema de evasão escolar”. Ela também destacou o “impedimento do acesso de crianças e adolescentes à merenda escolar durante a greve”.

Ao considerar esses quesitos, a magistrada conclui que existe um aparente abuso no movimento grevista. Ela ressaltou que a categoria não cumpriu o artigo 11 da Lei de Greve, não atendendo o número mínimo de professores em sala de aula para a garantia do serviço fundamental.

A Antecipação de Tutela representa uma determinação baseada em avaliação anterior à apreciação do mérito da questão, e foi concedida após recurso apresentado pela Procuradoria Geral do Município de João Pessoa (Progem-JP).

A categoria será informada por meio de intimação enviada ao Sindicato dos Trabalhadores em Educação do Município de João Pessoa (Sintem-JP), em caráter de urgência. Caso a medida não seja cumprida, a entidade será obrigada a arcar com uma multa de R$ 5 mil por cada dia de aula inviabilizado pela manutenção do movimento.

When considering these questions, the magistrate concludes that there is an apparent abuse in the strike movement. She stressed that the category has not complied with Article 11 of the Strike Law, not meeting the minimum number of teachers in the classroom to guarantee the basic service.

The Trusteeship Anticipation is a determination based on previous evaluation considered the merits of the case, and was granted after appeal by the Attorney General of João Pessoa County (Progem-JP).

The category will be informed by subpoena sent to the Union of Workers in Singapore of Municipal Education (Sintem-JP), on an emergency basis. If the measure is not met, the entity will be required to pay a fine of £ 5000 per day of class prohibited by movement of maintenance.)
